1.         Scope - General Provisions

1.1             We are Coxbury Ltd trading as Roche Bobois, (“Roche Bobois”).

1.2             These general conditions of sale (the "General Conditions") apply, without restriction or reservation, to the order by you (or the person identified on the order form) and supply by Roche Bobois of one or more goods (the "Product"(s)) as marketed on the website (the "Site") (the “Contract”).


1.4             These General Conditions set out the rights and obligations of Roche Bobois and you in respect of your order. No other terms are implied by trade, custom, practice or course of dealing. Nothing in these terms and conditions shall affect your legal rights as a consumer.

1.5             The Contract consists of:

1.5.1            these General Conditions and,

1.5.2            the order confirmation received by email by you.

1.6             If you are a business customer, the Contract constitutes the entire agreement between us in relation to your purchase. You acknowledge that you have not relied on any statement, promise, representation, assurance or warranty made or given by or on behalf of Roche Bobois which is not set out in the Contract and that you shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in this Contract and is the entire Contract between yourself and Roche Bobois in relation to the Products.

2.         These General Conditions

2.1             Please read these General Conditions carefully before you submit an order to us. These terms tell you:

2.1.1            who Roche Bobois are;

2.1.2            how Roche Bobois will provide you the Products (clause 7);

2.1.3            how you and Roche Bobois may change or end the Contract (clause 8); and

2.1.4            what to do if there is a problem and other important information.

2.2             By placing an order on the Site, you are confirming that you have read, understood and agreed to be bound by this Contract.

2.3             We recommend that you print a copy of these terms for future reference.

3.         Modification of the General Conditions

Roche Bobois reserves the right to modify these General Conditions at any time. The version of the General Conditions applicable to your order will be the one in force and online at the time you ordered the Products.

4.         Assignment and international delivery

4.1             If the Products are to be delivered to a non-UK mainland address, the Contract will be between you and another Roche Bobois franchisee company (“Franchisee”) located in the geographical area where Products are to be delivered in accordance with clause 5.11.

4.2             All information related to the Franchisee will be communicated to you before the validation of your order and confirmed in the order confirmation email.

5.         Order

Placing and acceptance of the order

5.1             You must place your order on the Site. Acceptance of your order will take place when Roche Bobois email you to accept it (“Confirmation Email”), at which point a Contract will come into existence between you and Roche Bobois.

5.2             The Confirmation Email will include the name and contact details of the Franchisee to which the Contract has been assigned. The Franchisee will be responsible for the processing, monitoring and delivery of the Products ordered.

If Roche Bobois cannot accept your order

5.3             If Roche Bobois is unable to accept your order, Roche Bobois will inform you of this in writing and will not charge you for the Product. This might be because the Product is out of stock, because of unexpected limits on Roche Bobois’ resources which Roche Bobois could not reasonably plan for, because Roche Bobois has identified an error in the price or description of the Product or because Roche Bobois is unable to meet a delivery deadline you have specified.

Personal information

5.4             When ordering, you must provide all the information requested. Roche Bobois will not be responsible for supplying the Products late or not supplying any part of the Products if this is caused by you providing incorrect information or not giving Roche Bobois the required information within a reasonable time.

5.5             In order to ensure the security of transactions and prevent fraud in means of payment, Roche Bobois reserves the right to verify the information you provide when placing an order. Consequently, Roche Bobois may ask you, by telephone or by e-mail, for one or more supporting documents. This request will have the effect of suspending the order pending the transmission of such supporting documents by email or post. In the event the supporting documents are not compliant or in the absence of a response from you, Roche Bobois may cancel the order and end the Contract and clause 10.2 will apply.

Terms of payment

5.6             You must pay for all Products in full when ordering.

5.7             Payment can be made by secure bank card (Visa, Carte Bleue, Mastercard, American Express). Roche Bobois reserves the right not to accept foreign bank cards.

5.8             Payment in 3 or 4 instalments free of charge by Visa or Mastercard credit card is available for orders between ninety Euros (€ 90) and three thousand Euros (€ 3,000). The first monthly payment is directly debited by credit card. The remaining three or four monthly payments will be taken from your bank account using the imprint of the bank card used. It allows the payment of the order to be staggered in 3 or 4 debits according to the following schedule:

5.9             For the 3 times by credit card

5.9.1            1st due date: the day of the order: 1/3 of the amount of the basket

5.9.2            2nd due date: 30 days after the order: 1/3 of the amount of the basket

5.9.3            3rd due date: 60 days after the order: 1/3 of the amount of the basket

5.10          For the 4 times by credit card

5.10.1         1st due date: the day of the order: 1/4 of the amount of the basket

5.10.2         2nd due date: 30 days after the order: 1/4 of the amount of the basket

5.10.3         3rd due date: 60 days after the order: 1/4 of the amount of the basket.

5.10.4         4th due date: 85 days after the order: 1/4 of the amount of the basket

5.11          Conditions of eligibility:

5.11.1         Payment must be made with a Visa or Mastercard CB (excluding Electron, Maestro, American Express, pre-paid CB and CB cards)

5.11.2         The credit card used must not expire for at least 90 days from the date the first payment is due.

5.11.3         This offer is reserved for individuals (adult individuals) residing in France or in a French department or territory. If the eligibility conditions are met, "payment in 3 or 4 instalments by bank card" is offered at the stage of the choice of payment. Estimated delivery date

5.12          The Confirmation Email will include an estimated delivery date for the Products. Once Roche Bobois has processed your order, Roche Bobois will provide you with an updated delivery date, which will be within 30 days after the day on which Roche Bobois accepted your order.

Changes to your order

5.13          Once Roche Bobois has sent a Confirmation Email, you cannot change or partially cancel your order. If you wish to make a change to the Product you have ordered, you will need to end the Contract in accordance with clause 8, and re-order the Products.

Order tracking

5.14          Upon receipt of the order confirmation email sent by Roche Bobois, you can monitor the progress of his order and delivery by clicking on the "MY ACCOUNT" then "MY ORDERS" on the Site.

5.15          You also have the possibility of following up his order by directly contacting the Franchisee in charge of the order or Roche Bobois Customer Service.

6.         Prices and products

Customization of Products

6.1             Except where the Products are already in stock, they will be made to order.

6.2             Although Roche Bobois has made every effort to be as accurate as possible, because some of the Products are handmade, all sizes, weights, capacities, dimensions and measurements indicated on Roche Bobois’ website have a 2% tolerance.

Product information

6.3             The products offered for sale online are those presented on the Site. The images of the products on Roche Bobois’ website are for illustrative purposes only. Although Roche Bobois has made every effort to display the colours accurately, Roche Bobois cannot guarantee that a device's display of the colours accurately reflects the colour of the products. Your Product may vary slightly from those images.

Availability of Products

6.4             In the event that the Products become totally or partially unavailable, following acceptance of an order by Roche Bobois, Roche Bobois will notify you by email and you will have the right to terminate the Contract in accordance with clause 8.2.

6.5             If you choose to cancel the Contract, Roche Bobois will reimburse the order within fourteen days of the date on which the Contract was terminated.


6.6             The price of the Product (which includes VAT) will be the price indicated on the order pages of the Site when you placed your order. Except where specified on the Site, the price of the Products does not take include delivery and installation costs. Delivery and installation costs will be set out before you complete order.

6.7             We take all reasonable care to ensure that the price of the Product advised to you are correct. However it is always possible that, despite Roche Bobois’ best efforts, some of the Products Roche Bobois sell may be incorrectly priced. Roche Bobois will normally check prices before accepting your order so that, where the product's correct price at your order date is less than Roche Bobois’ stated price at your order date, Roche Bobois will charge the lower amount. If the product's correct price at your order date is higher than the price stated to you, Roche Bobois will contact you for your instructions before Roche Bobois accept your order. If Roche Bobois accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, Roche Bobois may end the Contract, refund you any sums you have paid and require the return of the any Products provided to you.

7.         Delivery

Prior to delivery of the order

7.1             You are responsible for ensuring there is a safe path and space for the delivery of the Products to your address, including hallways, staircases and elevators, if applicable.

7.2             By checking the box "I accept the general conditions of sale and delivery", you certify that delivery of the Products is possible under normal conditions.

Delivery terms

7.3             Roche Bobois uses independent service providers (“Delivery Company”) to perform deliveries and installations. All Products will be delivered to the address specified by you when ordering. Roche Bobois’ Delivery Company will deliver and/or install the Products to one room of your choice.

7.4             When your Products are ready for delivery and/or installation, Roche Bobois’ Delivery Company will contact you by telephone (or failing that, by post or email) to agree delivery and installation dates. 

7.5             When arranging the delivery and/or installation of the Products with Roche Bobois’ Delivery Company, you must expressly report any access difficulties that Roche Bobois’ Delivery Company may encounter. If the Products cannot be delivered to your address because the Products ordered do not fit or if they cannot be safely delivered, Roche Bobois’ Delivery Company will leave you a note informing you of how to rearrange delivery.

7.6             All additional costs related to the delivery of the Products will be borne by you and invoiced by Roche Bobois’ Delivery Company in addition to the sale price and delivery costs mentioned on the Site.

7.7             You agree to be present on the delivery day agreed with the Roche Bobois’ Delivery Company and to check the compliance of the order upon receipt.

7.8             If you are unavailable on the day of delivery, you must contact Roche Bobois’ Delivery Company no later than one day before the delivery and/or installation date in order to arrange a new delivery day.

7.9             If no one is available at your address to take delivery and the Products cannot be posted through your letterbox, Roche Bobois’ Delivery Company will leave you a note explaining how to rearrange delivery.

7.10          If Roche Bobois’ Delivery Company is unable to deliver the Products for any reason, including but not limited to:

7.10.1         you provided the wrong address;

7.10.2         you were not available to accept delivery of the Products; or

7.10.3         you failed to specify any access difficulties that the Roche Bobois’ Delivery Company may encounter in advance of the delivery date,

you will be responsible for the redelivery costs. The costs of a new delivery will be the same as the initial shipping costs, excluding any discounts.

7.11          If you do not re-arrange delivery of the Products, Roche Bobois will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, after fifteen (15) days Roche Bobois are unable to contact you or re-arrange delivery, Roche Bobois may end the Contract and clause 10.2 will apply.

7.12          Following delivery of the Products, a copy of the invoice will made available to you on the Site.

Delivery and installation costs

7.13          The delivery and installation costs are subject to the delivery address provided by the Customer. The delivery and installation costs will be displayed to you on the Site prior to completion of the order.

Delivery times

7.14          Details of the estimated delivery times of each product can be found in the product description on the Site.

7.15          The Confirmation Email will include an estimated delivery date for the Products. This will be confirmed and refined in the days following the order, after Roche Bobois has carried out the technical checks and information.

7.16          Roche Bobois is not responsible for delays outside its control. If Roche Bobois’ supply of the Products is delayed by an event outside Roche Bobois’ control then Roche Bobois will contact you as soon as possible to let them know and Roche Bobois will take steps to minimise the effect of the delay. Provided Roche Bobois does this, it will not be liable for delays caused by the event, but if there is a risk of substantial delay, you may contact Roche Bobois to end the Contract and receive a refund for any Products you have paid for but not received.

On delivery

7.17          It is your responsibility to carry out all the necessary checks of the Products upon delivery. Before signing the delivery slip, you must:

7.17.1         check the apparent condition of the package(s);

7.17.2         check the condition of the Products inside the package(s); and

7.17.3         check the Products match the delivery note and the products ordered.

By signing the delivery slip, you acknowledge and agree it has undertaken the checks set out above.

7.18          If the Products within the packaging are faulty or damaged, please notify the Roche Bobois’ Delivery Company who will record it on the delivery note.

7.19          If you notice any damage to Products following delivery, please notify Roche Bobois as soon as possible. Please keep any damaged Products so that Roche Bobois can inspect them at a later date. If you dispose of any damaged Products before Roche Bobois has had the opportunity to inspect them, then this could affect any claim. Roche Bobois will always attempt to replace any damaged product. However, if Roche Bobois is unable to do so, Roche Bobois will refund you with the full amount you have paid for the product(s) together with any relevant delivery charges. Nothing in these terms affect your statutory rights.

7.20          The Products will be your responsibility from the time Roche Bobois deliver the Products to the address provided by you or the Roche Bobois’ Delivery Company collect the Products from Roche Bobois.

8.         Rights to end the Contract

8.1             Your rights to end the Contract will depend on what Products you have purchased, whether there is anything wrong with the Products, how Roche Bobois is performing and when you decide to end the Contract:

8.1.1            if the Product is faulty or misdescribed, you may have a legal right to end the Contract (or to get the product repaired or replaced or to get some or all of your money back), see clause 9;

8.1.2            if you want to end the Contract because of something Roche Bobois has done or is going to do, see clause 8.2;

8.1.3            if Roche Bobois are not at fault and you do not have the right to terminate, see clause 8.3; or

8.1.4            if you have simply changed your mind, see clause 8.4. You may be able to get a refund if you are within the cooling-off period but this may be subject to deductions.

8.2             If you are ending a Contract for a reason set out at clauses 8.2.1 to 8.2.3 below the Contract will end immediately and Roche Bobois will refund you in full for any Products which have not been provided and you may also be entitled to compensation. The reasons are:

8.2.1            Roche Bobois has told you about an error in the price or description of the Product you have ordered and you do not wish to proceed;

8.2.2            there is a risk that supply of the Products may be significantly delayed because of events outside Roche Bobois’ control;

8.2.3            you have a legal right to end the Contract because of something Roche Bobois has done wrong (including because Roche Bobois has delivered late).

8.3             Even if Roche Bobois is not at fault and you do not have the right to terminate, you can still end the Contract before it is completed, but you may have to pay Roche Bobois compensation. The Contract is only completed when the Product is delivered and paid for. If you want to end the Contract before it is completed, where Roche Bobois is not at fault and you do not have the right to terminate, just contact the Franchisee customer service and let them know. The Contract will end immediately and Roche Bobois will refund any sums paid by you for Products not provided but Roche Bobois may deduct from that refund reasonable compensation for the net costs Roche Bobois will incur as a result of your ending the Contract.

Product return procedure

8.4             For most products bought online you have a legal right to change your mind within fourteen (14) days from the day you receive the Products. If the Products are split into several deliveries over different days, you have until fourteen (14) days after the day you (or your representative) receive the last delivery to change your mind about the Products. If you have exercised your right to end the Contract, you have the choice of either requesting the exchange of Products or your reimbursement.

8.5             In order to return the Products, you should complete the form set out at Schedule 1 below, and send it to the Franchisee that processed the order and attach any supporting documentation relating to the order such as a copy of the delivery note. The Franchisee will contact you within 72 hours to provide details of the product return procedure.

8.6             You must return the Products via post, to Roche Bobois at the address communicated by the Franchisee, within fourteen (14) days of telling Roche Bobois, you wish to end the Contract.

8.7             If the Products are not suitable for posting, you should contact the Franchisee to arrange for Roche Bobois to collect the Products.

8.8             Roche Bobois will pay the costs of return:

8.8.1            if the Products are faulty or misdescribed;

8.8.2            if you are ending the Contract because Roche Bobois has told you of an upcoming change to the product or these terms, an error in pricing or description, a delay in delivery due to events outside Roche Bobois’ control or because you have a legal right to do so as a result of something Roche Bobois has done wrong.

In all other circumstances (including where you are exercising your right to change your mind) you must pay the costs of return.  

8.9             If you are responsible for the costs of return and Roche Bobois are collecting the product from you, Roche Bobois will charge you the direct cost to us of collection. The costs of collection will be the same as Roche Bobois’ charges for standard delivery.

9.         Exchange and refund of Products

If you have exercised your right to end the Contract, you have the choice of either requesting the exchange of Products or your reimbursement.

Exchange of Products

9.1             If you wishes to exchange the Products, you must follow the Product return procedure described above.

9.2             Once the return has been accepted by Roche Bobois, Roche Bobois will, subject to product availability, endeavour to deliver the new Products to you within:

9.2.1            3 weeks if the Products are in stock; or

9.2.2            within 12 weeks if Roche Bobois must order the Products from its suppliers.

9.3             If the Products requested by you are not available, Roche Bobois will inform you in writing and reimburse you in accordance with clause 9.4.

Refund of Products

9.4             Roche Bobois will refund you the price paid for the Products, including delivery costs, by the method you used for payment. However, Roche Bobois may make deductions from the price, as described below.

9.5             If you are exercising your right to change your mind:

9.5.1            Roche Bobois may reduce the refund (excluding delivery costs) to reflect any reduction in the value of the Products. If Roche Bobois refund you the price paid before Roche Bobois is able to inspect the Products and later discovers you have handled them in an unacceptable way, you must pay Roche Bobois an appropriate amount.

9.5.2            the maximum refund for delivery costs will be the costs of delivery by the least expensive delivery method Roche Bobois offer. For example, if Roche Bobois offer delivery of a product within 3-5 days at one cost but you chooses to have the Products delivered within 24 hours at a higher cost, then Roche Bobois will only refund what you would have paid for the cheaper delivery option.

9.6             Roche Bobois will make any refunds due to you as soon as possible. If you are exercising your right to change your mind then:

9.6.1            the refund will be made within 14 days from the day on which Roche Bobois receives the Product back from the Customer.

9.6.2            in all other cases, your refund will be made within 14 days of you telling Roche Bobois, you have changed your mind

10.      Roche Bobois rights to end the Contract

10.1          Roche Bobois may end the Contract for a product at any time by writing to you if:

10.1.1         you do not make any payment to us when it is due and you still do not make payment within 5 days of us reminding you that payment is due;

10.1.2         you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the Products, for example, your delivery address;

10.1.3         you do not, within a reasonable time, allow us to deliver the Products to you; or

10.1.4         you do not, within a reasonable time, allow us access to your premises to supply the services.

10.2          If Roche Bobois ends the Contract in the situations set out in clause 10.1 we will refund any money you have paid in advance for Products not provided but Roche Bobois may deduct or charge you reasonable compensation for the net costs we will incur as a result of your breaking the Contract.

11.      Guarantee

11.1          If you have any questions or complaints about the product, please contact us at

11.2          We are under a legal duty to supply Products that are in conformity with these General Conditions. See the box below for a summary of your key legal rights in relation to the Product. Nothing in these terms will affect your legal rights.

Summary of your key legal rights

This is a summary of your key legal rights. These are subject to certain exceptions. For detailed information please visit the Citizens Advice website or call 03454 04 05 06.

If your product is goods, for example furniture or a laptop, the Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product your legal rights entitle you to the following:

a) Up to 30 days: if your goods are faulty, then you can get an immediate refund. 

b) Up to six months: if your goods can't be repaired or replaced, then you're entitled to a full refund, in most cases. 

c) Up to six years: if your goods do not last a reasonable length of time you may be entitled to some money back.

11.3          In addition, Roche Bobois offers the following guarantee in respect of its Products:

11.3.1         the structure of each Product is guaranteed for 5 years.

11.3.2         the mechanisms and motors of the relaxation seats and headrests (including the convertible mechanisms), whether electric or manual, are guaranteed for 2 years.

11.3.3         batteries, transformers, pushbuttons and other electrical parts are guaranteed for 2 years.

11.3.4         the coverings (leather, fabric, varnish, patinas, etc.), seams, and visible woodwork are guaranteed for 2 years.

Disclaimer of warranties

11.4          The guarantee set out in clause 11.3 applies to domestic use only and covers defects in material and workmanship in the Products. It does not cover:

11.4.1         changes in the appearance of the covers and padding due to normal wear and use of the seat (softening or lapping of the foams);

11.4.2         the residual distension of the leather in the used seats;

11.4.3         discolorations, alteration or any modification or deterioration of aspects due to:       the excessive natural or artificial light;       the use of any maintenance product not suitable for the coating, as well as non-compliance with maintenance conditions;       external causes including but not limited to domestic accidents, water damage, stains, burns, scratches, animals;       improper assembly, setting or adjustment or other interventions carried out by persons not approved by Roche Bobois; or       sweating and natural perspiration of the body;

11.4.4         the migrations of shades and colours from articles in contact with the leather of the seats, the color of which is not stabilized (clothing, plaid, "decorative" cushions, belts, handbag, etc.).

11.4.5         deformation of seats, fixed or mobile mechanical structures, or structural damage resulting from improper use or intensive overloads concentrated on a given point resulting from improper use;

11.4.6         damage to items such as zippers, inter-unit fixings, headrest or armrest racks and various accessories resulting from improper use;

11.4.7         damage caused intentionally by a user;

11.4.8         use in public or professional places, unless there is a model suitable for this use and specified on the order form;

11.4.9         repairs or modifications which have been carried out by you or a company without the express written consent of Roche Bobois Customer Service.


11.5          In order to rely on the guarantee set out in clause 11.3, you must notify Roche Bobois of the defect as soon as it appears by completing the form available on the Site or by sending a letter accompanied by photographs to the Roche Bobois customer service of the Franchisee that delivered the order.

11.6          You must comply with the Product return procedure set out above.

11.7          The costs of returning the Products are the responsibility of Roche Bobois.

11.8          If you chooses to replace the Products within the framework of the guarantee set out in clause 11.3, Roche Bobois will be responsible for the delivery costs of the Products.

12.      Disputes And Responsibilities

12.1          If Roche Bobois fails to comply with these terms, Roche Bobois are responsible for loss or damage you suffers that is a foreseeable result of Roche Bobois’ breaking the Contract or Roche Bobois’ failing to use reasonable care and skill, but Roche Bobois are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the Contract was made, both Roche Bobois and you knew it might happen.

12.2          Roche Bobois does not exclude or limit its liability to you in any way, where it would be unlawful to do so. This includes liability for death or personal injury caused by Roche Bobois’ negligence or the negligence of Roche Bobois’ employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products as summarised at clause 11.2 and for defective products under the Consumer Protection Act 1987.

12.3          If Roche Bobois are providing services in your property, Roche Bobois will make good any damage to your property caused by us while doing so. However, Roche Bobois are not responsible for the cost of repairing any pre-existing faults or damage to your property that Roche Bobois discover while providing the services.

12.4          Roche Bobois only supply the products for domestic and private use. If you uses the products for any commercial, business or re-sale purpose Roche Bobois will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

12.5          If you are a business user, Roche Bobois:

12.5.1         excludes all implied conditions, warranties, representations or other terms that may apply to the Products; and

12.5.2         will not be liable for any loss or damage which may be suffered, whether directly or indirectly, immediate or consequential, and whether arising in contract, tort (including negligence), or otherwise, which falls into the following categories:       loss of profits, loss of sales, loss of business or loss of revenue;       business interruption;       loss of anticipated savings;       loss of business opportunity;       loss of goodwill or damage to reputation; or       any indirect or consequential loss or damage.

13.      Alternative dispute resolution

Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without the parties having to go to court. If you are not happy with how Roche Bobois has handled any complaint, you may want to contact the alternative dispute resolution provider Roche Bobois use. You can submit a complaint to AME (European Mediation Association). AME will not charge you for making a complaint and if you are not satisfied with the outcome you can still bring legal proceedings. In addition, please note that disputes may be submitted for online resolution to the European Commission Online Dispute Resolution platform.

14.      Computer law, files and freedoms

Roche Bobois will only use your personal information as set out in Roche Bobois’ Privacy Policy.

15.      Intellectual property

15.1          Roche Bobois are the owner or the licensee of all intellectual property rights in the Site, and in the material published via the Site. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

15.2          You are not authorized to reproduce, exploit, distribute, or use for any purpose whatsoever, even partially, elements of the Site, whether they are software, visual or audio. The texts, images, drawings and the layout as well as the graphic charter of this Site are protected by copyright laws and treaties around the world. It is forbidden to copy, extract, distribute, modify or adapt the content of the Site.

15.3          You may print off one copy, and may download extracts, of any pages from the Site for your personal use. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way from the Services, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Reproduction of drawings, images, sound documents, video sequences and texts in other electronic or printed publications requires the prior written consent of Roche Bobois.

15.4          You must not reproduce, sell or exploit for any commercial purposes any part of the Site, access to the Site or use of the Site or any services or materials available through the Site without obtaining a licence to do so from Roche Bobois.

16.      Use of cookies

Roche Bobois’ cookie policy sets out information about the cookies on our Site.

17.      Severability of clauses

Each clause in these General Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses will remain in full force and effect.

18.      Non waiver

If Roche Bobois does not insist immediately that you do anything they are required to do under these General Conditions, or if Roche Bobois delays in taking steps against you in respect of your breaking the Contract, that will not mean that you do not have to do those things and it will not prevent Roche Bobois taking steps against you at a later date.

19.      Transfer of Rights

19.1          Roche Bobois may transfer its rights and obligations under the Contract to another organisation. Roche Bobois will contact you to let you know if it plans to do this. If you are unhappy with the transfer, you may contact Roche Bobois to end the Contract within 14 days of Roche Bobois telling you and Roche Bobois will refund the customer any payments they have made in advance for Products not provided.

19.2          You need Roche Bobois’ consent to transfer your rights to someone else (except that you can always transfer Roche Bobois’ guarantee). You may only transfer your rights or obligations under these General Conditions to another person if Roche Bobois agrees to this in writing. However, you may transfer the guarantee to a person who has acquired the Product. Roche Bobois may require the person to whom the guarantee is transferred to provide reasonable evidence that they are now the owner of the relevant Product.

19.3          This Contract is between Roche Bobois and the Customer. No other person shall have any rights to enforce any of its terms, except as explained in clause 19.2 in respect of Roche Bobois’ guarantee.

20.      Language, applicable law, mediation and competent jurisdiction

20.1          The General Conditions are written in English. In the event that they are translated into one or more languages, only the English text will prevail in the event of a dispute.

20.2          These General Conditions are governed by English law.

20.3          The parties will seek, before any litigation, an amicable agreement.

20.4          In the absence of an amicable agreement, you can bring legal proceedings in respect of the Products in the English courts. If you live in Scotland, you can bring legal proceedings in respect of the Products in either the Scottish or the English courts. If you live in Northern Ireland, you can bring legal proceedings in respect of the Products in either the Northern Irish or the English courts.
